Often the question is asked, "how long does it take?". The answer most often given is "How long is a piece of string!". Not a lot of help, I'm sure you'll agree. Unfortunately there really are no regulation time frames the lenders are forced to adhereto, some companies will say otherwise. These other companies would have been correct, but changes in the consumer credit act were made after the government bought into the UK banking system with the bailout. They removed some of the red tape witch make the whole process a little quicker.
If your entertaining the idea of taking on your lenders, you will probably say to yourself "where do I start, what do I do?". Valid question's and the information is available in the public domain and some people are naturally putting this information to use and standing their ground with their lenders. The problem we have experienced with private individuals representing themselves, is the banks assume your taking a "shot" at getting your credit card balance written off. Most people all send the same standard form letters they downloaded from some website and ultimately get fobbed off with excuses, lies, and even get bullied in to dropping their case.
If you have decided that you absolutely want to represent yourself with your credit card claims, the following information should serve as some useful information for your efforts.
Step You Should Take
Initial request to release agreement from lenders. 1 week
Credit agreements start to come back from lenders.
Please note: 40 days only commences once the lender considers it has all relevant information (including cleared payment of search fee). 40 days
Missing Information requested and returned. 1 month
Analysis of your credit card card agreements 2 weeks
After you have assessed your agreements and identified the unenforceable agreements, you can begin to draft your correspondence to the lender requesting the balance be "written off". 4 weeks
Progression of claim. This is where your real challenge begins, being ready to put up a fight with the lender whilst operating within the procedures set out in the Consumer Credit Act. Legal guidance should be followed for a fast and successful conclusion. 4 to 12 months
